New Mexico ranked #4 in Charter School Accountability

According to an article released in Santa Fe by the New Mexico Public Education Department, New Mexico ranked #4 in the United States for charter school accountability.

A recent study released by the National Alliance For Public Charter Schools, moved New Mexico up 16 places from 2011. The report, Measuring Up to the Model: A Ranking of State Charter School Laws, recognizes New Mexico for the quality of its charter school laws including strengthened performance-based charter contract requirements.

Governor Susana Martinez signed a new law in 2011 which would require annual evaluations for accountability and contracts between charter schools and authorizers as well as provide a means to revoke a charter from any school not meeting requirements in student achievement.

Governor Martinez expressed, ?Our efforts to reform education in New Mexico include making sure all schools serve every student. This report shows, once again, education reform is making New Mexico a national leader.?

Today, New Mexico charter schools serve over 17,000 students in over 80 schools across the state.

The Public Education Department is aggressively working to finalize the law signed in 2011 which will bring stronger accountability to charter schools along with New Mexico's new A-F School Grading System.

The shocking tale?s many threads began meshing in the mid 2000s. They were revived this week by the latest in a series of leaks that have rocked the Vatican ? leaks observers believe are the result of an internal power struggle, one that has fuelled speculation about jostling to succeed Pope Benedict XVI.

This time, a January letter from Rev. Federico Lombardi, the Vatican?s spokesperson, has made its way to the media.

The three-page letter, revealed by a program on the state-owned Rai Tre channel, focuses on the kidnapping of Emanuela Orlandi, a 15-year-old Vatican City resident who disappeared in 1983. She was last seen leaving her regular piano lesson outside the Vatican City walls. Her father was a clerk in the office organizing papal events.

Last summer, a former member of De Pedis? infamous Magliana gang, Antonio Mancini, was interviewed by La Stampa newspaper after spending years in jail. He said De Pedis had loaned the Vatican a huge sum of money. There is speculation it was to help fund Solidarity, the 1980 democracy movement in Poland, John Paul?s homeland.

Mancini said Orlandi was kidnapped to pressure the Vatican when some of the money wasn?t returned. De Pedis? girlfriend had said similar things a few years earlier.

At the time, the Vatican was the main shareholder of Banco Ambrosiano, which had gone bankrupt. Roberto Calvi, Ambrosiano?s head, was found hanging from a London bridge in 1982.

Mancini said part of De Pedis? peace deal with the Vatican included burial in Sant?Apollinare, a church built in the 18th century and now run by the ultra-conservative Opus Dei movement. Church officials say De Pedis was buried there because he helped the poor. They?ve had less to say about the ruthless, Rome-based gang he headed.

In January, Orlandi?s brother led a demonstration in front of the church, demanding the tomb be opened. Since an anonymous call to Rai Tre in 2005, there has been talk of it perhaps containing evidence of Orlandi?s disappearance. The Orlandi family wants to know if the body in the tomb is indeed De Pedis?.

In his letter, Lombardi alludes to the rumours, according to excerpts released by Rai Tre. He also notes the cardinal in charge of the basilica has said he?s willing to have the tomb opened.

?I don?t understand why this hasn?t happened yet,? Lombardi writes.

Lombardi then discusses the Vatican?s refusal to help Italian police on some aspects of the Orlandi kidnap investigation. He wonders ?if the non-collaboration with the Italian authorities . . . was a normal and justifiable affirmation of Vatican sovereignty, or if in fact circumstances were withheld that might have helped clear something up.?

Earlier leaks of Vatican documents included recent private letters to the Pope complaining of corruption and cronyism in the awarding of contracts. Other documents emerged reigniting allegations of money-laundering at the Vatican?s bank. Finally, a bizarre confidential letter from a Vatican official described a presumed plot to kill Benedict and discussed his potential successor.

The day before Lombardi?s letter became public, another TV channel broadcast an interview with a man claiming to be a Vatican employee who leaked one of the documents. He looked like the Mafia turncoats Italians are used to seeing on TV ? much of his face was covered by sunglasses, hat and scarf, and his voice was disguised.

He complained about the failure to investigate the Orlandi kidnapping and alluded to the death of two Vatican Swiss guards in 1998. In that incident, Alois Estermann, commander of the Pontifical Swiss Guard at the Vatican, was killed, along with his wife, by Cedric Tornay, a young Swiss guard who then shot himself.

That murder-suicide has spawned books filled with theories as to what really happened. One widely quoted scenario comes from Ferdinando Imposimato, a former magistrate who officially investigated some of the biggest criminal cases in Italy, including the shooting of Pope John Paul in 1981, and cases involving De Pedis? gang.

Imposimato is convinced secret police services in the former Soviet Union were involved in the plot to kill John Paul. He says Estermann was a spy for East Germany?s Stasi secret police, and was involved in Orlandi?s kidnapping. She was targeted because her father was the first to suspect Estermann as a spy, and told Imposimato so in 1981. Estermann was eventually killed, Imposimato says, because he knew too much.

Imposimato is now working with the Orlandi family. Both are pushing for a full investigation ? and the opening of De Pedis? tomb.

Motorola Droid RAZR, RAZR MAXX update pushing out

Update: Because so many people are just starting to get the update (thanks for the e-mails, everybody!), we're going to bump this post -- something we try to avoid doing for obvious reasons.

Original from Feb. 6: If you're the proud owner of a Motorola Droid RAZR, or it's brother with a bit bigger gas tank the Motorola Droid RAZR MAXX, (read the review of the MAXX right here)  there's an OTA update ready and waiting for you.  Version 6.12.173.XT912.Verizon.en.US (there's no way we could make that one up) started slowly rolling out over the weekend and is now pushing hard and heavy, and chances are you can grab it yourself by simply going to Settings>About Phone>System Updates.  

The update itself is about 150MB in size, and updates the software to Android 2.3.6.  I know many were wanting Ice Cream Sandwich, but this update brings some welcome bug fixes and security patches, so we'll gladly take it.  The full change list, line by line:

Did you find it odd that headlines suggest that the President who got us out of Iraq and then in and out of Afghanistan is now being accused of starting another war? It's even stranger that the new war is supposedly being declared against the Roman Catholic Church or against religious freedom.

Those are deceptive headlines. You may have also read that "Catholic leaders are upping the ante" and threatening to challenge the Obama administration over a provision of the new health care law that would require all employers, including religious institutions, to pay for birth control.

Catholic leaders are responding to a provision of President Barack Obama's new heath care reform bill that requires Catholic schools, hospitals and charities as secular employers to provide coverage for birth control pills, abortion-producing drugs and sterilization for their employees.

Full disclosure: I have personally received letters from William Donohue, the head of the Catholic League. It's not unusual for him angrily to label lots of things "anti-Catholic." As he tries now to mobilize 70 million Catholic voters, Donohue's rhetoric sunk to a new low as he claimed, "Never before, unprecedented in American history, for the federal government to line up against the Roman Catholic Church. This is going to be fought out with lawsuits, with court decisions, and, dare I say it, maybe even in the streets."

There are lots of political pundits who can't figure out why the President would pick this fight in what could be a close election year. But what if Human Services Secretary Kathleen Sebelius appropriately acted on the Institute of Medicine's recommendation, which focused on reproductive rights as they relate to best health-care practices? Secretary Sebelius actually exempted churches. Other administration officials said they, "certainly don't want to abridge anyone's religious freedom."

But this requirement protects the freedom of those with coverage to decide about their own healthcare. It's strange that some of the folks who don't want the government involved in healthcare at all or in such "personal" decisions seem willing to allow such interference by other institutions in extremely personal choices under the umbrella of religious freedom.

Writing for National Review Online, Yuval Levin described how institutions such as the Catholic Church provide what he calls "mediating layers" between the individual and the state which create civil society. He argues that this "current fight" is "just one more example of President Obama's attempt to bulldoze civil society .. .to sweep away the middle layer so that individuals may have a more direct and personal encounter with the state." Yuval goes on to conclude:

This approach is especially noxious and pernicious when it is directed at religiously affiliated institutions -- both because they deserve special standing and because they do some of the hardest and most needful work of charity and care in our society. We should use every available means to protect those institutions from this mortal danger, and that certainly includes resorting to the language of conscience and exemption." (Ibid.)

Pro-choice groups have replied with equally intense language, such as the National Abortion Rights Action League's President Andrea Miller, who comments that, "[t]he Catholic hierarchy seems to be playing a cynical game of chicken and they don't seem to care that the health and well being of millions of American woman are what's at stake here."

Many years ago I learned as an Episcopal priest that some of the folks who are my employees are rightly considered "secular hires." What that means is that even though they work in and for the Church, they do jobs that are not defined by the religious doctrine or core beliefs of that Church. Examples might be nurses or janitors or CFO's or security personnel. Clergy, church musicians, religious educators, and other employees whose jobs are grounded in the particular faith tradition of their employer are treated differently under employment law -- the government is loathe to get involved in labor disputes within those categories. But when disputes involve "secular hires" the employer is obligated to conform to standard labor/employment State and Federal regulations and laws.

Pro-choice voices claim this issue is about the right of "secular hire" employees of Catholic institutions to have birth control and other services paid for as part of their health care plan. In other words, such employees may decide not to use such services for religious reasons, but an employer cannot deny them access for religious reasons. If that is correct, Yuval and others are simply wrong to assume that what's at stake is "the hardest and most needful work of charity and care in our society." (Ibid.) This is not a matter of conscience that should be given special exemption because of religious freedom or charitable effectiveness. Rather, with secular hires, the Church should want to be held to the highest standards of employment law and best employer practices. Some who oppose the provision say it forces people of faith to choose between upholding Church doctrine and serving the broader society. Actually, religious employers who responsibly live in that tension help to sustain our civil society.

Fiscal Sponsor Swipes Non-Profits' Cash | The Joy Trip Project

For his stand to protect wilderness environmental activist Tim DeChristopher got a two-year prison sentence. But the man trusted to manage the finances of his non-profit Peaceful Uprising walked away with considerably more. Steve Sugarman executive director of the fiscal sponsor organization the International Humanities Center is being sought in California by state and federal authorities. His group is believed to have misappropriated almost $1 million in charitable donations contributed to DeChristopher?s and more than 200 other philanthropic organizations nation-wide. A story in the Los Angeles Times puts the total at $877,000. Though he came highly recommended by many Sugarman seems to have played on the trust of the most giving to bilk do-gooders out of their cash in a Ponzi-scheme worthy of financier Bernie Madoff.

When DeChristopher put a stop to the auction of public land in Utah he was convicted of a crime. But his acclaimed act of civil disobedience, which aimed to hold the oil and gas industries accountable for their role in climate change, created a national movement. Peaceful Uprising now works to raise the stakes in the effort to end global warming. But like any philanthropic organization the group of activists still has to cover expenses. And with the help of a fiscal sponsor it works within the law to raise money and prompt public action to achieve social change. But little did the non-profit realize the cash it collected from donors was vulnerable to theft.

Under its status as a 501(c)(3) organization a fiscal sponsor helps non-profits legally collect and distribute tax-deductible funds contributed by the general public. For a fee ranging between 3 and 20 percent the sponsor pays the group?s bills and satisfies its obligations to the federal government. It?s common practice for a small activist organization to outsource these particular duties and Sugarman?s International Humanities Center had many satisfied customers.

?They had a great reputation with different climate organizations, women?s justice organizations. And after talking to a few different people everyone said these were the people to go to,? said Cori Redstone of Peaceful Uprising. ?And at first they were really responsible. We could get a hold of them and they were taking care of things.?

But all that changed late last year as things slowly began to unravel. Redstone?s group became aware that several of its employees were not being paid.

?A lot of our phone calls went unanswered as well as our emails,? she said. ?We got less and less communication and finally sometime in December we were finally able to get a hold of Steve Sugarman, who gave us a round-about story and started acting erratically. Finally he told us that they were shutting down.?

With $35,000 in unpaid bills and a total of $88,000 in donations unaccounted for Peaceful Uprising received notice that the Center was going out of business. The Los Angeles Times reports that Sugarman told some executive directors of effected non-profits that he ?blamed the problems on the economic downturn and an anticipated $15.2-million grant that never materialized.? But as the Times reports he neglected to inform his clients that the IRS had filed a $69,570 tax lien against the Center. And In September 2011, the California ?state Franchise Tax Board suspended the Center?s corporate status because it had failed to file the nonprofit equivalent of a tax return.?

Now that his clients and law enforcement are looking for him Sugarman is nowhere to be found. And each non-profit is left to figure out how they will ultimately recover.

?It?s going to take a long time to replace this money,? Redstone at Peaceful Uprising said. ?But regardless of what happens we?ve always been a volunteer organization. We?ve very rarely had many funds to draw on and so we know that we will go on and continue to do the work that we do. We?ll just have to scale back a little bit.?

The same is likely true of many of the effected groups. Operating on shoestring budgets they?re unfortunately used to this kind economic hardship. But despite this experience non-profits will still need to rely on fiscal sponsors to manage their money in the future.

?The reason they?re doing this is they don?t want to take on the financial responsibility themselves,? said John Sterling, executive director of the Conservation Alliance, a non-profit that funds environmental protection initiatives throughout the United States. ?These groups are usually high on passion and low on experience when it comes to governance. But you?ve got to do your homework and ask a lot of questions in the non-profit world.?

As the situation in California unfolds charitable organizations will likely use this as a teaching moment. Not to distract from their important work they must recognize that despite their selflessness they are still? vulnerable to deception.

?People in the non-profit sector are very empathetic and trusting which makes us the perfect target for this,? Redstone said. ?The best thing to do is to just be totally transparent and be open with our donors as well as be open with the non-profits and let people know that this does happen.?

It remains to be seen whether Sugarman intended to steal his clients? money from the outset. Some speculate that he perhaps over extended himself in a frenzied rush to have non-profit contributions keep pace with expenses. His best intentions not withstanding the money is apparently gone and it?s not coming back.? When you play fast and loose with the funds and resources of others you?ll always run the risk of coming up short. Just like in a game of musical chairs as players shift from one seat to the next those without the skill or experience to avoid it will be left standing alone with nowhere to go when tune suddenly stops and jig is up.

Leaked: Conservative Group Plans Anti-Climate Education Program

Leaked documents from the free-market conservative organization The Heartland Institute reveal a plan to create school educational materials that contradict the established science on climate change.

The documents, leaked by an anonymous donor and released on DeSmogBlog, include the organization's 2012 fundraising plan. It lists Heartland Institute donors, from the Charles G. Koch Charitable Foundation (established by Koch Industries billionaire Charles G. Koch), to Philip Morris parent company Altria, to software giant Microsoft and pharmaceutical company Eli Lilly.

The climate change education project is funded so far by an anonymous donor who has given $13 million to the Institute over the past five years. Proposed by policy analyst David Wojick, who holds a doctorate in epistemology and has worked for coal and electricity generation companies, the project would create education "modules" written to meet curriculum guidelines for every grade level.

"Many people lament the absence of educational material suitable for K-12 students on global warming that isn't alarmist or overtly political," the report reads. "Heartland has tried to make material available to teachers, but has had only limited success."

Funding skepticism

Heartland focuses on free-market issues across the board, including promoting charter schools, lobbying for business-friendly finance, insurance and real estate rules and promoting prescription drug availability before full Food and Drug Administration testing.

In the area of climate change, the leaked documents revealed that the group funds vocal climate skeptics, including Center for the Study of Carbon Dioxide and Global Change founder Craig Idso ($11,600 per month), physicist Fred Singer ($5,000 plus expenses per month), and New Zealand geologist Robert Carter ($1,667 per month). They've also pledged $90,000 to skeptical meteorologist Anthony Watts, who blogs at WattsUpWithThat.com.

The documents also reveal a communications strategy aimed at "keep[ing] opposing voices out" of publications such as Forbes Magazine, where the audience is "reliably anti-climate."

On the education front, Wojick would be paid $5,000 per module, or $25,000 per quarter, according to the report's tentative estimates, to produce the Heartland climate curricula. The Institute's anonymous donor has pledged $100,000 to the project, which the Institute hopes to match from other donors.

Each module would inject skepticism into the scientific consensus on climate change. Example statements in the report include: "Whether humans are changing the climate is a major scientific controversy;" "Models are used to explore various hypotheses about how climate works. Their reliability is controversial;" and "Whether CO2 [carbon dioxide] is a pollutant is controversial." The modules would also teach that the idea of carbon dioxide as a pollutant is "controversial," arguing that carbon dioxide is crucial to life on Earth and that natural emissions are 20 times those of human emissions.

Creating controversy

In fact, while some of these statements may be politically controversial, they are not particularly scientifically controversial. For example, the Intergovernmental Panel on Climate Change 2007 Fourth Assessment Report, which synthesizes global scientific findings about climate change, states: "Since the start of the industrial era (about 1750), the overall effect of human activities on climate has been a warming influence. The human impact on climate during this era greatly exceeds that due to known changes in natural processes, such as solar changes and volcanic eruptions."

| Arresting Motion: Estate Planning for Artists :: Epilawg

Part I: The Big Picture.

As an estate planning attorney, I like the idea that I help clients ?arrest motion? by codifying their desires in a present moment for some, hopefully distant, future when they are no longer able to voice those desires. I find this description particularly appropriate when working with artist clients. Estate planning for artists is an area of the law plagued with nooks and crannies that even well established and highly respected estate planning attorneys can easily miss. It is simply a fact that, due to lack of exposure, many estate planning attorneys may not be versed in the unique complexities that are involved in planning for the artist. In colloquial terms, they don?t know what they don?t know.

This seven-part series will shed light on some of these artist-centric estate planning issues. Accordingly, the series has a two-fold agenda:

• The first goal is to arm artist clients with the knowledge needed to identify an adequate attorney who can best address these unique estate planning needs.

• The second goal is to provide the estate planning attorney unfamiliar with the specific planning concerns of artists with information to help them better recognize and address the needs of these very special clients.

This topic area, like so many others that fall under the heading of ?Estate Planning? is complex. An article, book, or law school class could be dedicated to almost any single subject area mentioned in this series. Therefore, the reader is encouraged to view the series as an introduction to the subject matter and its biggest components as well as a springing point to inspire further study. Since this series is focused on the world of creativity, it has been organized according to the Six W?s of Writing? ? Who, What, When, Where, Why and How.? Many may remember these fondly, or maybe not so fondly, from high school English class.

Admittedly, the term ?artist? can be ambiguous. One of the several definitions that Merriam-Webster.com provides for ?artist? is ?one who practices an imaginative art.? For the purposes of this article, this seems a fitting description. ?Artist? shall include visual and performing artists, as well as writers, designers, animators, and, generally, anyone involved in producing a creative body of work.

To a greater degree, attorneys should be aware that the issues addressed in this series may also apply when working with any client who falls under the heading of the ?creative class? as coined by Richard Florida in his groundbreaking and, now, classic The Rise of the Creative Class, which includes everything from graphic designers to video game developers. However, this article is primarily aimed at that group which has most traditionally been considered ?artists? and will pinpoint examples specific to the particular area of art where appropriate.

On a personal note, a family friend, who was also a retired judge, once shared with me one of the biggest lessons he learned over his many years on the bench. In his long Texas drawl, he said, ?If there is one thing that attorneys hate more than admitting a mistake, it?s admitting they don?t know something.? As an attorney, I like to think my fellow members of the bar and I constantly strive to deepen our well of knowledge. In that respect, both the attorney and artist should take away the following seven items from this series:

1. Why it is so important for an artist to create an estate plan;
2. Who the unique players are and their roles in managing the estate of an artist;
3. What the special layers of rights and assets may be in the artist?s estate;
4. When an artist should begin the planning process;
5. Where an artist should contemplate formalizing an estate plan;
6. How a few estate planning tools can address the artist?s estate planning needs; and
7. Homework items an artist can start immediately to minimize estate issues.

Part II of this series will identify the need of estate planning for artists, both by showing that a market exists and defining the importance of planning for artist clients.

CSN: Zimmerman's contract no back-burner issue for Nats

It has only been 34 months since Ryan Zimmerman and the Nationals last agreed to a long-term contract, the five-year, $45 million deal that ensured the face of the franchise would continue to hold that title into the prime of his career.

So why worry about his next contract already, with Zimmerman unable to become a free agent for another two years?

Because that's the way baseball works, and the time to lock up marquee players is right now, before they get too close to free agency.

Clubs that let their top stars reach the final year of their contracts take an awfully big risk. And as we've seen lately, they often wind up losing their man. Just ask the Cardinals if they wish they had locked up Albert Pujols two years ago, and the Brewers if they wish they had done something to keep Prince Fielder.

So 2012 figures to be an important year for the Nationals in their quest to keep Zimmerman in a curly W cap for the rest of his career. And, if you believe Zimmerman, the window of opportunity won't remain open much longer.

Citing his desire not to become a distraction to his teammates, the 27-year-old third baseman has let the Nationals know he doesn't want to negotiate a deal after he reports for spring training.

Does that mean the two sides have only one more week to get something done? Not really. Zimmerman may establish artificial deadlines in his mind, but there's no reason he can't extend it into March or beyond, if need be. In fact, that's exactly what he did three years ago when negotiating his current contract.

Zimmerman arrived in Viera in Feb. 2009 saying he wanted to get his contract worked out right away, early in camp and certainly before Opening Day. But the process dragged on through the entire spring, and it wasn't until 15 minutes before the season's first pitch when Zimmerman and the Nationals agreed to the basic framework of his $45 million extension. Even then, there were still plenty of details that had to be worked out before the final contract was signed on April 20.

So there's no reason to believe a similar process can't play out again over the next two months, or perhaps even into the summer.

Why hasn't a deal already been struck? Zimmerman has made it clear he wants to stay in D.C., having long since been convinced the franchise will become a winner. And the Nationals are committed to keeping their first-ever draft pick in uniform for the long haul, making this negotiation one of their top priorities for the coming months.

It's never as easy as it sounds, though, no matter how much goodwill has been established by both sides. You're talking about what's likely to be at least a seven-year extension worth perhaps $140 million or more.

Those kind of deals don't just come together overnight. They take a lot of back-and-forth discussion, some strong differences of opinion and often a good bit of creativity before they are finalized. And the Nationals and Zimmerman's agent, Brodie Van Wagenen, have been working on this one since last year, though to date they haven't made enough progress to believe a deal is imminent, according to sources familiar with the discussions.

Why the difficulty in finding common ground? Perhaps in part because of the inconsistent nature of Zimmerman's big-league career to this point. He's twice in the last four years spent considerable time on the disabled list, missing two months in 2008 with a small tear in his shoulder and then missing another two months last season with a torn abdominal muscle.

Those injuries have prevented Zimmerman from posting consistently big numbers at the plate, with those sub-par 2008 and 2011 seasons sandwiched around his stellar 2009 and 2010 campaigns when he hit .299 with an average of 29 homers and 96 RBI.

The Nationals aren't overly concerned that injuries are going to continue to sidetrack Zimmerman's career -- these haven't been chronic ailments and in both cases he made a full recovery -- but they are somewhat reluctant to pay out a huge sum to a player who has yet to establish his dominance over a long period of time.

On the other hand, Zimmerman understands now might not be the best time to sign an extension, not with his value down a bit following that injury-plagued season. This is likely to be the last major contract he signs, and he doesn't want to squander the opportunity by agreeing to a lesser deal when his value is not at its peak.

It takes two to tango, and until the Nationals and Zimmerman are together in step, a deal won't be reached.

If Zimmerman really won't let negotiations stretch into the season, there's a limited window of opportunity to get something done. But if the Nationals hold firm on what they're willing to offer, there won't be much discussion to be had.

All of which could make for an intriguing spring for this franchise and the young man who has embodied it more than anyone else for nearly seven years.
