Iran's dentist to the stars offers views on US

TEHRAN, Iran ? Prior to the Islamic revolution, Iran and America shared very good relations. The former Shah of Iran, Mohammad Reza Pahlavi, had an army with modern hardware supplied by the U.S. There were direct flights between New York City and Tehran and the city was full of hotels run by major American chains.

But the once-friendly relations between the two nations came to a screeching halt in 1979 when cleric-led radicals ousted the U.S.-backed shah and the subsequent Iran hostage crisis when 52 Americans were held in the U.S. embassy for 444 days.?

These days, Iranians? relations with America are somewhat schizophrenic ? the government is stridently anti-American, but many Iranians are not.?

That is the opposite of other countries in the region where governments receive large amounts of money and military hardware from the U.S., but whose people generally dislike America.

Tehran?s dentist to the stars
A popular dentist in an affluent part of Tehran represents the love-hate relationship many Iranians feel toward the U.S.

In his Park Avenue-style dental practice, the latest Newsweek, Time and Architectural Digest magazines are on offer in the waiting room. A large flat-screen TV sits on the wall, along with an expansive fish tank and a framed dentistry degree from New York University.?

Iranians are consumers who love brand names ? even when it comes to their dental care. When a friend of mine introduced me to the dentist, he told me he is the guy to go to if I wanted to brag about where I get my teeth cleaned. He is, in essence, Tehran?s equivalent of a Beverly Hills ?dentist to the stars.?

A large part of his reputation comes not just from the fact that he has all the latest, modern dentistry equipment, but that he was trained in the U.S. and offers Western-style service. He was educated in dentistry at NYU and lived, worked and studied from the East Coast to West Coast.

Coffee mugs bearing pictures of the late Apple co-founder Steve Jobs are on sale as a man works on a MacBook at a shop in northern Tehran on Jan.19, 2012. Despite the fact that Apple observes a U.S. embargo that restricts the sale of their goods in Iran, their products are wildly popular there.

Sporting fashionable glasses, a crisp blue button-down shirt and tie, the dentist, who is in his mid-40s, agreed to speak with me on the condition of anonymity. ?

?I am who I am because of my education in the States,? said the dentist. ?I am very American, but my view on U.S. politics is very different.?

I asked him what he thought about the tough economic sanctions being imposed on Iran ? which block access to the international banking system and hurt?sales of Iranian crude oil ? as a way to persuade Tehran to abandon its nuclear program.

Iranians feel the pain of sanctions: 'Everything has doubled in price'

?Why are there sanctions against Iran?? he said. ?Wasn?t it America that helped Iran fire up its nuclear program 35 years ago? The sanctions just hurt ordinary people.??

At the same time, he praised Iranians? resilience.

?After 30 years of sanctions, embargoes, war and threats of war, Iran has kept its head above water,? he said. ?Most other countries would have collapsed, but Iranians have found ways to circumvent these problems; they help each other.?

NBC News speaks with citizens from around the globe, asking the question, 'What Does America Mean to You?'

The dentist believes that one reason for? misunderstanding between America and Iran is that Americans have little real information on Iran ? that they know only what they see on TV, which is often a very small part of the bigger picture.

For years, he says, he tried to convince American colleagues to give lectures on dentistry in Iran, but that they were reluctant to do so because of their perceptions. When one of them finally agreed to come, and experienced the famous Iranian hospitality and warmth, his perception of Iran changed very quickly.

Asked why he came back to Iran about eight years ago after spending most of his life in the States, he said he just felt like something was missing, adding that he loves Tehran because it?s like New York City ? a noisy, fast-paced 24/7 place.

Steve Jobs photos on the wall
The desire for brand names in Iran that signify Western quality goes beyond dentistry.?

Mohsen, who agreed to speak with me on condition that only his first name be used, owns an electrical goods store in Tehran selling mostly black market Apple products. (Typically, Apple, as well as other imported goods that would be subject to U.S. embargoes, come into Iran via Dubai and the Persian Gulf. They are sold openly in stores in Tehran).?

He said that most Iranians love American products and culture and that personally he longs for the day that the two countries have normal relations.

Then a frown appeared on his face. ?But,? he said, ?they do things that even rub a moderate person, like me, the wrong way.?

?I read an article yesterday about an Iranian-American who went into an Apple store in the States and wanted to buy an iPad to send to her uncle in Tehran. When the sales person found out she was Iranian and wanted to send the iPad to Iran, the store refused to sell it to her,? he said.

?This is crazy! I sell 50 iPads and iPhones here a week. I have a picture of Steve Jobs on the wall! These sorts of things don?t do any good for relations between Iranian and American people.??

The story Mohsen related was widely reported in the U.S. An Apple employee in Atlanta declined to sell an iPad to an Iranian-American customer, citing company policy that aims to comply with U.S. trade sanctions with Iran that can lead to individual fines of up to $250,000. ?

Iran trade sanctions get personal in Apple stores??

In the meantime, Mohsen?s Apple products will have to remain on the black market.?

Still, not all Iranians have such a moderate view towards the U.S. Hussein, a hard-line student at Tehran University, has a very negative view of the States. (He also spoke on condition that only his first name be used.)

?All America has done is try to bully Iran, chip away at its nuclear rights and steal our oil,? Hussein said.

?I don?t think we should be talking to the Americans because ultimately they want our demise,? he said. ?Throughout history, they have interfered in our country, only harming us. We have nothing in common.?

City's European Green Capital bid

Bristol will discover later whether its green credentials are good enough for the city to be named the most environmentally friendly in Europe.

The race to be European Green Capital in 2014 is coming to an end with three out of the original 18 bidding cities still in contention - Copenhagen, Frankfurt and, smallest of all, Bristol.

It is not an award that comes with a hefty cash prize - in fact Bristol wouldn't win a penny, just a title.

But the city council has researched the fortunes of previous winners and claims that being Green Capital could bring a thousand jobs to green industries in the city, and media coverage over the winning year worth ?1m.

These are figures to be taken with a sizeable pinch of salt though as there have only been three previous winners in this young competition.

On paper, Copenhagen (population: 541,989) seems an obvious choice.

Traffic gridlock

In the Danish capital, 35% of the population already cycle to work or school. New parks are being established so Copenhagen can meet its target of having a beach or green space within 15 minutes' walk for every resident. It also wants the entire city to be powered by renewables in 2025.

And Frankfurt (population: 664,838) can boast that it has managed to considerably reduce both its water consumption and the amount of waste it produces despite the city growing in size.

Bristol goes into this final elimination stage as the underdog?

End Quote

So with Bristol (population: 441,300) famed for its traffic gridlock, expensive public transport and poor air quality, it seems lucky to have gotten this far.

But this is not a competition based just on your current performance levels. Cities are also ranked according to how they plan to improve their lot and Bristol has come up with a strategy or two.

The judges were so persuaded by Bristol's level of planning that in the first round of scoring it actually came top for air quality, noise pollution and climate change.

Plans for the future aside, Bristol also has a strong story to tell as the country's only official Cycling City, as the home to green institutions like Sustrans, the Soil Association, ethical bank Triodos and the Environment Agency, and as a place rich in green space with the countryside never far away.

Street parties

It has also topped urban league tables for recycling, though the closest Bristol will now come to the return of trams is most likely bendy buses on guiding concrete rails.

And it has also been noted that while there have been German (Hamburg) and Scandinavian (Stockholm) winners of the EU Green Capital title before, it has yet to come back to Britain.

Were it to do so, Bristol would have to stage a year of green-themed activities in 2014. Its provisional plan is for 300 sustainability-themed street parties and an arts fiesta called The Festival of the Amazing.

Whether you see this award as a meaningless accolade or the passport to burgeoning eco-prosperity, Bristol goes into this final elimination stage as the underdog. But then that is a position the city has always seemed to relish.

My Journey to 40 and Fabulous | The Institute of Health and Fitness ...

Guest Blogger Nicole Troll

?

A little more than a year ago I had an epiphany.? Okay, I had a crazy idea to lose weight ? 40 lbs. to be exact, by my 40th birthday.? I called it My Journey to 40 and Fabulous.? My intentions were good, but the pressure that I put on myself was not.

Long story short, over the past year I have tried.? I failed.? I made excuses and failed again.? But instead of giving up, I tried again and this time I was successful at doing the things that started me on this journey ? being a role model for my family and learning to eat healthier so that I can prolong my time on this earth with them.

?

Month after month, you patiently listened and supported me on this journey and I am grateful for your readership.? I hope that you continue to read on because my journey is not yet over.

On April 1st I began an intense 90-Day Fitness Challenge after being selected one of six contestants to participate in the program.? The program, which would normally cost me $1,500 for nutritional assistance, gym access and a personal trainer, was graciously offered to the six of us for free by The Institute of Health and Fitness here in Chula Vista (http://theinstituteofhealthandfitness.com/blog/), AKA Body By Bobbie.? see full story??? here.

Google I/O 2012: Live Updates From Google's Event

Another week, another enormously important tech event. This week, it's Google's I/O 2012, and this Google event comes with some added pressure to live up to the standards set by competitors.

See, two weeks ago, Apple held its WWDC event and subsequently wowed the tech world with the Retina MacBook Pro and some spiffy new features in iOS 6. Last week, Microsoft earned high praise for two events -- the flashy premiere of the sleek Surface tablet and its low-key Windows Phone 8 unveiling.

Given those impressive antecedents, you can see why there's extra pressure on Google to have a successful day.

Can Google match the excitement and sense of optimism generated by Apple and Microsoft in the weeks prior? What will Larry Page and Sergey Brin's behemoth unveil at the Wednesday keynote address (which you can view live by clicking right here, or watching the video embedded at the top of this post, starting at 12:30 p.m. ET!) to wow the tech world and inspire developers to write for Android?

We've heard talk of a $199, 7-inch Nexus tablet that could compete with the Kindle Fire; we might also see Android 4.1 "Jelly Bean," the next iteration of the Android operating system and the logical successor to Ice Cream Sandwich. What features might we see in this Jelly Bean that can rival the dazzle of Maps and Siri in iOS 6, or the redesigned home screen and all-important "shared core" in Windows Phone 8?

We'll be live-blogging, and insta-analyzing, all the news that comes out of the Google I/O keynote, starting at 12:30. Check below for updates.

Union angered as schools release figures

Teacher unions have told schools to flout the law and refuse to release national standards data to the media.

But some schools have already released figures showing how many of their students are meeting the standards and what they're doing to improve achievement.

The Dominion Post has asked schools across the Wellington region to release the information they were required to send to the Education Ministry about the number of pupils at, above, below or well below national standards in reading, writing and maths.

The ministry declined a request for the data, but acting senior manager Dennis Cribb said individual schools could be approached.

About 10 have already responded with information and others have indicated their data will be forthcoming.

Some of the data released includes results from 2010 and 2011, showing pupils' progress between years.

But teachers union, the New Zealand Educational Institute, said schools should not give results to the news media and should instead refer any requests for the information to the ministry.

"We are entering a new era of `naming and shaming' schools in order to sell newspapers and even worse, the publication of league tables will be unfair and based on faulty, misleading and valueless misinformation," NZEI president Ian Leckie said.

The Principals' Federation has also advised schools on ways to try to prevent league tables being created from the information they supply.

In an "urgent" advisory, NZPF president Paul Drummond suggested schools should "consider reporting in general terms".

Mr Leckie said parents wanting to know about a school's performance should talk with the teachers and principal. They could also look at Education Review Office reports.

"We would also ask members of the news media to take a close look at their own ethics before publishing data that will be narrow, unfair and inaccurate," Mr Leckie said.

Dominion Post editor Bernadette Courtney said: "We have asked for this information because we believe parents have a right to see it."

Last night, Education Minister Hekia Parata said the data was public information but she wanted to see it used responsibly.

The ministry has indicated it will release data in September.

Jelly Bean home screen revealed, automatically accomodates your apps and widgets

It's a pain manually moving apps and widgets on Android screens, ain't it? Well, at Google I/O 2012, the folks in Mountain View have just given us some Jelly Bean salve to soothe that irritation. The latest Android OS automatically arranges onscreen icons around any new widgets or apps you choose to insert. Not only that, but you can also remove any unwanted apps and widgets with a simple swipe up and off the home screen to delete them. A welcome Android addition, to be sure, but it begs the question, when will us non-Nexus owners get to enjoy it?

HomeFix Weekly Review: Keep Cool, Save Money

Saving money is important, but so is keeping cool in the summertime. With rising energy costs, it may seem difficult to do both at the same time. However, it is not impossible. You will find that energy efficiency is not so difficult to achieve, and you can save money by making some changes that may cost some money up front, but will end up saving more money than spent. HomeFix Corporation is one of the leading home improvement professionals on the East Coast, specializing in energy efficient upgrades. This post will give you several ideas to stay cool without breaking the bank in the heat.

Improve Your Windows

Depending on the size of the investment that you are willing to make, you can save a substantial amount of energy and money by improving the energy efficiency of your windows. The most effective choice would be to purchase replacement windows that are more efficient than your old ones. Energy efficient windows can prevent the transfer of heat in several different ways, such as the air flow around poorly installed or old windows, and the flow of heat through the pane itself. The most efficient models will allow sunlight to stream through the windows, while minimizing the heat from the sun that enters your home. This would be the most effective and permanent solution.

If there are gaps around your windows, it would be worth your while to seal them. You would be surprised at the amount of heat and air that flows through your home, relative to the size of the gap, so the energy efficiency of your home can only be improved by this quick home fix.

Black out curtains or shades will help decrease the amount of energy wasted on cooling costs, but keep in mind that this is only true when the shades or curtains are closed, so you will need to use lamps in a room with this solution, no matter the time of day.

Insulate to Keep Cool

It may seem?counter intuitive, but proper insulation goes a long way toward keeping your home cool in hot weather. Because heat flows from hot to cold, and insulation serves as a barrier against it, efficient insulation keeps heat either outside or inside.? Aside from what we refer to as "insulation" which is installed in places such as your walls and the attic, the materials that comprise your home also have an insulation value. Your roof, which has an SPF factor that deteriorates over time, is constantly subjected to light and heat from the sun. This is great news for homeowners with solar panels installed, but not so great when it comes to homes with old or low quality materials on the roof. An inspection by a contractor can tell you if your roof is in need of repair, or replacement, or if an upgraded roof would benefit you by improving your home's energy efficiency.

Additionally, your siding plays a major role in insulating your home, as well as protecting it from the elements. Newer materials are more efficient due to new technology and advances, and also because of deterioration over time. The specific material that your siding consists of plays a part as well. For example, wood and aluminum will not insulate as well as certain types of vinyl. Of course,?aesthetics?are also important, so fortunately new manufacturing methods can mimic the look of various materials, such as wood or cedar, crafted from energy efficient vinyl.

Mark Wahlberg Happy To 'Look Stupid' For 'Ted'

'I'm just ready to get crazy, look stupid, come off as being ridiculous,' star tells MTV News about Seth MacFarlane's live-action debut.
By Kara Warner

No matter how hilarious and realistic the furry and foul-mouthed star of "Ted" might appear in the trailers and clips, the human stars of the film did not get an animated bear to physically act with: Instead, they had to rely on their own imaginations and "act with nothing" for much of filming.

When MTV News caught up with Mark Wahlberg and Mila Kunis recently during the film's press day, we asked them what acting skills they discovered or honed while making Seth MacFarlane's live-action debut.

"I've really found myself in a really comfortable position," Wahlberg shared. "I've always said that years ago I wouldn't have been able to do something like this: I was a little too self-conscious. And now, being a married father of four, I don't give a sh-- about what anyone thinks. So I'm just ready to get crazy, look stupid, come off as being ridiculous, and that's what acting is.

"I really admire — and I've seen it in some really young actors — coming from a musical background, coming from the street, always worrying about being cool, wanting to be perceived as hip, you don't want to do too many things that may make you look a little skeptical," he continued. "I remember when we were doing 'Four Brothers' and telling Tyrese and André Benjamin to look at Garrett Hedlund, and no matter how ridiculous he looked, he would still be willing to try anything, and I admired it."

Wahlberg went on to say that his total comfort in his own skin has come via different stages in his career and being able to take risks and that "Ted" — coming to theaters Friday — is a perfect fit for his mindset right now: "This is full-blown, ass in the air, not caring about anything," he said with a smile.

Wahlberg's love interest in the film is played by Mila Kunis, who was the first to admit that in terms of the difficulty of acting to nothing, she had the easy job.

"I didn't have it as hard as Mark did. Mark had it pretty rough because he had a lot of physical activities with the bear," she explained. "I just had to talk to an imaginary friend. You know sometimes when you're driving and you have conversations in your head? This was kind of like that except [done] outward.

"And I had MacFarlane in my ear through an earwig, so I didn't feel like I was talking to space necessarily. He was off to the side hooked up to a machine acting the bear out, and I was getting the feed into my ear."

Check out everything we've got on "Ted."

Physical fitness may improve survival among diabetes patients with ...

Being physically fit may improve survival rates among diabetes patients with a particular type of heart abnormality, a new study determines. The results will be presented at The Endocrine Society's 94th Annual Meeting in Houston.

In the United States, nearly 26 million people have diabetes, according to the American Diabetes Association. Being overweight or obese increases the risk of diabetes, and more people are developing the disease as the obesity epidemic continues. Treatment includes making lifestyle changes and taking medication to control blood sugar.

Left ventricle hypertrophy, or LVH, is an abnormality characterized by a thickening of the muscular walls of the heart's main pumping chamber, which can reduce its ability to pump enough blood to meet the body's needs. Causes of LVH include high blood pressure, and other heart and medical conditions. Medications are available to treat the disease.

While both diabetes and LVH can increase the risk of death, the effects of these diseases in relation to physical-fitness levels were unclear.

In this study, diabetic patients who were not physically fit and had LVH were the most likely to die, while physically fit patients, both with and without LVH, had a significantly lower risk of death. The differences remained even after investigators adjusted for potential influences, including high blood pressure, excess body weight, smoking, and medications. In each group, the risk of death compared to patients with low physical-fitness levels and no LVH was:

  • 20 percent greater ? low physical fitness with LVH
  • 41 percent lower ? physically fit without LVH
  • 43 percent lower ? physically fit with LVH

"Exercise fitness markedly improves survival in patients with type 2 diabetes and left ventricle hypertrophy," said lead author Khaled A. Alswat, M.B.B.S., endocrinology fellow at Washington, D.C. Veterans Affairs Medical Center, George Washington University. "We also found that improvement in fitness improves survival significantly, regardless of the presence or absence of left ventricle wall thickness."

Beginning in 1986 and continuing until 2011, 866 male veterans with type 2 diabetes and an average age of 61 years enrolled in the study at the Veterans Affairs Medical Center in Washington, D.C

At the study's start, participants underwent a standard exercise assessment with a treadmill to determine fitness level and were then classified as either low fit or physically fit. In addition, all patients received a special test, known as an echocardiogram, which can diagnose LVH with sound waves that generate an image of the heart muscle, including its contractions and relaxation. The follow-up was as long as 24 years, with a median of almost 9 years. During the course of the study, 346 deaths occurred, which is an annual rate of 4.3 percent, overall.

Pope convenes cardinals over leak scandal in bid to restore 'serenity and trust' in church

VATICAN CITY - Pope Benedict XVI convened a special meeting of cardinals Saturday for advice on how to deal with the Vatican's leaked documents scandal ? another sign of the damage the leaks have done to trust in the Holy See's governance.

Benedict was already scheduled to attend a regular meeting of the heads of Vatican offices Saturday morning. The Vatican press office said he added a second meeting later in the day with other cardinals in a bid to try to "restore a climate of serenity and trust" in the church.

The Vatican said over the coming days he will meet with still more cardinals gathering in Rome for a church feast day on Friday to "continue the dialogue with the people who share the responsibility of the church's governance with him."

The Vatican has been scrambling to contain the damage after the leak of hundreds of Vatican documents exposed corruption, political infighting and power struggles at the highest level of the Catholic Church. The pope's butler, Paolo Gabriele, is under arrest at the Vatican, accused of aggravated theft after the pope's own documents were found in his Vatican City apartment.

One Holy See investigation into the links is a criminal one headed by Vatican gendarmes; there is also an internal probe led by a commission of three cardinals tasked with getting to the bottom of the scandal.

Last weekend Benedict met with the cardinal's commission to learn details of some of the two dozen people they have questioned.

The meetings Saturday were another indication of the seriousness with which he has taken the scandal and the damage it has done to the trust that is supposed to form the basis of the Vatican's governance.

In its statement, the Vatican said the regularly scheduled meeting with department heads aimed at coordinating the Vatican's work was "today particularly important and urgent to show efficient witness to the union of spirit that animates the Curia."

The second meeting Saturday includes Vatican cardinals, and the archbishops of Sydney and the retired vicar of Rome ? two longtime papal advisers.

Benedict also moved to beef up a panel of cardinals tasked with scrutinizing the `'organizational and economic problems of the Holy See," the Vatican said. He appointed to the panel three cardinals: Polycarp Pengo, an archbishop from Tanzania, in Africa; and two Asians, Telesphore Toppo, from India, and John Tong Hong, the Hong Kong prelate who was elevated to the rank of cardinal earlier this year by the pontiff.

All three are involved with the Holy See office that bankrolls missionary work abroad. Two years ago, Italian prosecutors began probing real estate transactions and other dealings of Naples' cardinal, an Italian prelate who formerly headed that office. The Italian authorities have been looking into an alleged web of kickbacks and favors, including purported sexual ones, involving businessmen, church hierarchy and public officials.

Toppo also serves on a cardinals' watchdog committee for the activities of the Vatican bank.

Technology ? Sony, Sumitomo Electric develop world's 1st green semiconductor laser

TOKYO ?

Sumitomo Electric Industries and Sony Corp have successfully developed the world?s first semiconductor laser diode with an optical output power of over 100 mW in the true green region at a wavelength of 530 nm.

This laser diode can be mounted on laser projectors and many other display devices. The new laser diode features twice the luminosity compared with conventional gallium nitride (GaN) green laser diodes, and a color gamut broadened by 182% based on the NTSC standard (CIE 1976 color gamut). As a result, these significantly improve the performance of laser projectors and other display devices to reproduce vibrant video and images.

Red and blue laser diodes have been commercially available among the primary red-green-blue (RGB) colors, but there has been greater need for high output green laser diodes towards the development of high performance laser projectors and display devices. Currently, green lasers are generated by converting the wavelength of infrared laser light from a light source using optical materials, but the light source is large and expensive. In addition, conventional GaN-based green lasers have difficulties achieving sufficient luminosity as their performance is limited to an output power of several tens of milliwatt at a wavelength of 520 nm or less.

To overcome these challenges, Sumitomo Electric and Sony collaborated in the development of a true green semiconductor laser for practical use, drawing on Sumitomo Electric?s semi-polar GaN substrate, crystal growth, and wafer processing technologies, as well as Sony?s GaN-based laser technology, acquired through the Blu-ray development.

By introducing new techniques and improving the entire semiconductor laser production process, including structural design, crystal growth, wafer processing, and electrode configuration, Sumitomo Electric and Sony were able to successfully develop true green semiconductor laser with an optical output power of more than 100 mW at a wavelength of 530 nm. This true green semiconductor laser diode is highly reliable as it realizes wall-plug efficiency of over 8%.

East Peoria roundabout officially open, Mayor says don't be confused

EAST PEORIA, Ill -- East Peoria officials say they are making huge progress on the downtown development project.

East Peoria Mayor Dave Mingus said this project has been more than 10 years in the making.

Friday night, officials gathered to celebrate the completion one more piece of the puzzle, the roundabout located in the heart of the new downtown area.

This is the first roundabout in East Peoria and some have found it confusing.

Mayor Mingus said it will get better with time, "I think the simple thing is to just come down now, when its not so congested. And the other thing is to just relax and watch the signs and everything is pretty self-explanatory. The anxiety might be a little more dangerous than the roundabout itself."

Mayor Mingus adds more than 100,000 square foot of development is still taking place.

NFL denies witness retractions in bounty probe

By BRETT MARTEL

AP Sports Writer

Associated Press Sports

updated 7:19 p.m. ET June 21, 2012

NEW ORLEANS (AP) - The NFL denies accusations it covered up retractions made by key witnesses in its bounty investigation, or that Commissioner Roger Goodell has placed gag orders on Saints employees and others who could help punished players clear their names.

Lawyer Peter Ginsberg, who represents suspended Saints player Jonathan Vilma, made the accusations when punished players appeared earlier this week for an appeal hearing, a full transcript of which has been obtained by The Associated Press.

NFL spokesman Greg Aiello says claims of a gag order are "completely untrue," and that no potential witnesses were instructed by the league to stay away from Monday's hearing.

The transcript also shows that the NFL Players Association formally asked Goodell to recuse himself from ongoing appeal proceedings, contending that he is incapable of ruling "without the appearance of bias."

"The commissioner has publicly appeared on television and in other (forums) defending the discipline," NFLPA attorney Jeffrey Kessler said. "We would ask that the commissioner step down, to the extent that these proceedings continue, as the decision maker and that a neutral decision maker be appointed in his place."

The early portions of the transcript detail a series of verbal jousts that Ginsberg sought to deliver to the commissioner before leaving the appeal hearing early in protest.

In discussing witnesses he has been unable to speak with, Ginsberg told Goodell, "You have made threats to keep them from talking to us. You have refused to have them even participate in today's proceedings."

Ginsberg and the NFLPA had asked the NFL to compel several witnesses to appear at the appeal hearing, including Saints head coach Sean Payton, assistant head coach Joe Vitt, general manager Mickey Loomis, former defensive coordinator Gregg Williams, and former defensive assistant Mike Cerullo.

While the NFL declined to require anyone to attend the hearing, Aiello said the players and their representatives "were free to bring any witnesses of their choosing, including any coaches if they agreed to appear."

Ginsberg further asserted that Williams and Cerullo offered retractions of some of their initial statements to the NFL in the investigation, and that the league has neglected to share that information. Aiello denied such retractions were ever made.

Ginsberg also accused the NFL of distorting evidence introduced at the appeals hearing, including an email from marketing agent Mike Ornstein to Williams, who the NFL says ran a bounty program from 2009 to 2011.

In the email, Ornstein tells Williams he gave him "1,500 last week, I will give you another 1,500 the next four game (sic) and the final 2,000 the last 4." Ginsberg asserts that the NFL included the email as evidence even after Ornstein told Goodell the email related to a Gregg Williams charity.

The NFL declined to comment beyond its assertion in Monday's hearing that the total amount of money the email discusses - $5,000 - matches the amount listed next to Ornstein's name on a note outlining pledges made as "seed money" to a performance incentive pool that rewarded big plays as well as injurious hits.

Ginsberg told the commissioner he imposed a "misplaced punishment" which "cast a shadow not only on Mr. Vilma personally and professionally, but, I dare say, on the NFL and on the office of the commissioner in engaging in these proceedings."

He then concluded his statement by urging Goodell to "rescind any punishment against Mr. Vilma and to apologize in public for what you have done."

Not long after making those statements on the record, Ginsberg, who is also representing Vilma in a separate defamation lawsuit against Goodell in federal court in New Orleans, left the hearing with Vilma in protest, They did not return for an afternoon session.

Later in the hearing, Kessler said the remaining three punished players - Saints defensive end Will Smith, Green Bay defensive lineman Anthony Hargrove, and linebacker Scott Fujita - would listen to the remainder of the hearing, but would decline to participate because they believed the proceeding lacked elements required to meet the standard of a "fair hearing" under the NFL's current labor agreement.

"The essence of that hearing contains certain matters that are being denied to the players here," Kessler said. "In particular, we're not being given the opportunity to confront and cross-examine the actual witnesses who have evidence on this."

Kessler made an additional point that the NFL has already stated publicly that Williams, the defensive coordinator, ran the Saints' incentive pool, and that punishing employees for something their employers instructed them to do is "contrary to established legal principles."

The NFL continued its portion of the hearing in which it reviewed evidence against the players.

Goodell did not recuse himself and it did not appear he would consider doing so after league attorney Adolpho Birch responded to Kessler that an arbitrator already ruled Goodell has the authority to hear the appeal.
